Ordinances Regarding a Permanent Location to Occupy

As the title suggests, this topic is to list all the relevant ordinances for creating a permanent occupation site and camping location. I feel this will help keep things organized and help us to stay on track.



In The Case of Being GRANTED Waivers:

Pay close attention to "Sec. 191.119." as getting waivers from the city to remove the requirement for insurance, permits, sanitation requirements and any related fees will probably be our best bet.


Tents Are Not Dwellings:

It's a little ways down the page, so I'll just quote the definition here...

"Dwelling, one-family or single-family means a building containing only one dwelling unit. The term is not to be construed as including recreational vehicles, tents, houseboats or other forms of temporary or portable house. Manufactured homes and modular homes which comply with the provisions of Subpart C, Part 4 of the Zoning Code are considered single-family dwellings. For the purposes of this Zoning Code, row houses, townhouses, condominiums, cooperative apartments or other form of dwelling units which are not in individual detached buildings meeting all the requirements of a single-family dwelling shall not be construed to be single-family dwellings. A building in which a room or other portion is rented to or occupied by someone other than a part of the family shall not be considered to be a single-family dwelling."

...therefore we shouldn't be required to have our tents inspected and deemed as illegally erected structures for refusal to do so!


Tents Are Classified as Temporary Housing:

"Temporary housing means a tent, trailer or structure used for human shelter which is designed to be transportable and which is not attached to the ground, to another structure or to a utility system on the same premises for more than 30 consecutive days."

"Each applicant shall submit a non-refundable application fee with the initial application, to help defray the City's cost of processing the application and coordinating the relevant City services and personnel. The fee for any proposed special event shall be $100 for the first calendar day, plus $50 for each whole or partial subsequent calendar day, not to exceed a maximum amount of $200."

So... $200. Because I'm pretty sure we'll be there longer than 3 days.

Commercial General Liability: $1,000,000 Each Occurrence.

Which, according to Kara and Jamie, from Legal Aid, costs something like $700/yr.

Keith, I saw something regarding exemption for adopt-a-park things under 191.103. Is this worth investigating? If we were to adopt the land we occupy, we may be able to bypass the permit process.

We're not exactly an "organization". So I don't know how we'd get approved for something like that... I'll look into it though
